EUROPELEC, the data controller (hereinafter “we”, “us”, “our”), wishes to inform you in a clear and transparent manner about the use of cookies when you consult the website (hereinafter the “Site”).

1. Preamble

When you visit the Site, information relating to the browsing of your terminal (computer, tablet, smartphone, etc.) may be recorded in text files called “cookies”, installed on your browser. The cookies will be used to recognise your browser during the period of validity of the cookie concerned and will return certain information to the Site (for example, the choice of language).

Only the issuer of the cookie concerned is likely to read or modify the information contained in it.

There are different types of cookies:

  • session cookies, which disappear as soon as you leave the Site;
  • permanent cookies, which remain on your terminal until their lifetime expires or until you delete them using the features of your Internet browser.

2. Definitions

Personal data: means any information relating to an identified or identifiable natural person. An “identifiable natural person” is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

Applicable regulations on the protection of personal data: means the French and European regulations applicable in the field of the protection of personal data. This includes, but is not limited to:

  • the law relating to data processing, files and freedoms n° 78-17 of January 6, 1978 modified and its possible updates as well as its texts of application;
  • the applicable European regulations, in particular Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation – GDPR) repealing Directive 95/46/EC ;
  • recommendations, guidelines and deliberations of supervisory authorities, in particular the French Data Protection Authority (CNIL) and the European Data Protection Committee (EDPS).

3. Origin of the cookies

The cookies used can be :

  • nos cookies ;
  • cookies deposited by partners on our behalf (subcontractors) (see 7.6);
  • cookies from third-party companies, which are responsible for processing a limited number of data in order to achieve specific objectives (see 7.7).

4. Purpose of cookies

The purpose of the cookies used by our Site, which require your prior consent, is to analyse and measure the Site’s audience and to improve performance.

5. Consent

5.1 Cookies used for strictly necessary purposes

In accordance with the applicable regulations on the protection of personal data, we do not ask for your consent to use these cookies as they are strictly necessary for the proper functioning of the Site.

5.2 Cookies used for purposes not strictly necessary

We will only store or read cookies on your device that are not strictly necessary and process the associated Personal Data (or allow our partners to do so) if you have given and not withdrawn your consent.

5.3 How to provide your consent for non-strictly necessary cookies

When you first visit our Site, you will be prompted to consent to cookies that are not strictly necessary. You can accept them all by selecting “Accept All” or refuse them by selecting “Refuse All”.

When you accept or refuse the deposit of cookies, a cookie is deposited on your terminal for a period of 14 months in order to record your choice. If you delete this cookie, it will no longer be possible to identify you as having accepted or refused the use of cookies. Consequently, the choice concerning cookies will be offered again the next time you visit the Site.

If you do not consent to cookies that are not strictly necessary, no cookies will be placed and we will not process any Personal Data relating to them.

Any use of a cookie or associated Personal Data prior to the withdrawal of your consent will be valid and legal.

5.4 Consequences of refusing / withdrawing your consent to cookies

If you refuse or withdraw your consent to the use of non-strictly necessary cookies, the relevant functionality or features of the Site may not function properly, if at all. Your use of the core features of the Site will not be affected.

If you disable strictly necessary cookies (or all cookies) using your Internet browser settings, one or more of the Site’s core functions and features, including those designed to ensure that your visit is safe and secure, will not function properly, if at all.

6.1 Your Preferences Management Center

The Preference Management Center is a module that allows you to choose which cookies you wish to accept or reject on our Site.

At any time, by clicking on the button at the bottom left of the screen you can access the Preferences Management Center.

6.2 Internet browser settings

You can configure your Internet browser in such a way that cookies are stored on your terminal or rejected, either systematically or according to their sender. You can also regularly delete cookies from your terminal via your Internet browser.

The configuration of each Internet browser is different. For example :

6.3 Opposition Platforms

Several professional advertising platforms also offer you the possibility of refusing or accepting cookies used by their member companies. These centralized mechanisms do not block the display of advertisements but only prevent the installation of cookies allowing the adaptation of advertisements to your centers of interest and behavior.

For example, you can log on to the site to prevent these cookies from being installed on your terminal. This site is proposed by the digital advertising professionals grouped within the European Digital Advertising Alliance (EDAA) and managed in France by the Interactive Advertising Bureau France.

You will be able to find out which companies are registered with this platform and which offer you the possibility of refusing or accepting the cookies they use to adapt, according to the data they collect, the advertisements that may be displayed on your browser.

This European platform is shared by hundreds of Internet advertising professionals and constitutes a centralized interface allowing you to express your refusal or acceptance of cookies as specified above.

7. Protection of personal data

7.1 Categories of Personal Data

In connection with the use of cookies as described above, we may process Personal Data about you as a data controller.

We receive the following categories of Personal Data:

  • Internet browser cookie data: cookie identifiers, time/date, selected services/products, consent and approved cookie types;
  • Device data: device type, screen resolution, operating system version, browser rendering kernel, version and basic settings;
  • Log data: time and duration of use of the Site and search data;
  • Location data: data about your country of access as indicated by your device;
  • Behavioral data: data about your use of the Site that we may process if you visit or use third-party sites or applications to cooperate with us, and data about how you participate in the content of the Site (such as pages visited, whether you come from a marketing campaign, clicks on buttons, etc.) ;

7.2 The purposes of the processing

The purposes of these cookies are detailed in the paragraph “Purpose of the cookies used”.

7.3 The legal basis for the processing

The processing of your Personal Data collected from cookies is based on your consent.

As for the processing of your data from cookies strictly necessary for the provision of the Site and its operation, it is based on our legitimate interest.

7.4 How long we keep your Personal Data

Cookies are never kept longer than necessary to achieve the purpose of the cookie. The data collected from cookies is kept for a maximum of 14 months.

7.5 Recipients of your Personal Data

The data collected by the cookies used by the Site will be communicated to our authorized personnel.

7.6 Subcontractors

Our third party service providers, agents and contractors, business partners, group companies and other third parties (hereinafter referred to as “contractors”) may receive Personal Data related to cookies directly from you or from us.

We disclose or provide access to your Personal Information to them for the purposes strictly necessary for the performance of their services, as set out in Article 4.

The majority of the suppliers we use are subcontractors with whom we have a contract in place that requires them to keep your information secure and not to use it other than in accordance with our specific instructions.

For the cookies used on the Site, we use the following subcontractor:

  • Google Analytics ;
  • SFA.

7.7 List of companies using trackers on our Site as data controllers

We do not place third-party cookies from other companies on the Site.

7.8 Transfers of Personal Data outside the European Union

Your Personal Data related to cookies may be transferred outside the European Economic Area (“EEA”), if you give us your explicit consent to do so or if we provide adequate safeguards for the protection of the data transferred.

In the context of Google Analytics and/or the use of analytical, marketing and social networking cookies, your Personal Data may be transferred, once you have given your consent, to companies based in the United States and stored on servers located in the United States.

Please note that such transmission may present a risk to the processing of your Personal Data due to the lack of an adequacy decision and appropriate safeguards. In particular, the transmission and processing of Personal Data by our partners in the United States may be subject to surveillance programs by U.S. government authorities and your Personal Data may be accessed by U.S. intelligence agencies or federal investigators. Non-U.S. individuals also do not have the same ability to counter surveillance by the relevant U.S. authorities. Finally, the United States does not have a single data protection authority.

If you use the Site when you are outside of the UK and the EEA, your information will be transferred outside of these territories to enable you to access it.

7.9 Your rights

You have the right to access, rectify, delete, and port your data, as well as the right to limit processing.

You also have the right to object at any time, on grounds relating to your particular situation, to the processing of Personal Data which has our legitimate interest as its legal basis.
